Freedom Cups provides its content on (the "Site") subject to the following terms and conditions (the "Terms"). We may periodically change the Terms, so please check back from time to time. These Terms were last updated on January 25th, 2016. By accessing and using this Site, you agree to these Terms.
For an explanation of Freedom Cups practices and policies related to the collection, use, and storage of our users' information, please read our Terms of Purchase and Privacy Policy pages.
1. Copyrights
All content and functionality on the Site, including text, graphics, logos, icons, and images and the selection and arrangement thereof, is the exclusive property of Freedom Cups or its licensors and is protected by Singapore Law and international copyright laws. All rights not expressly granted are reserved.
2. Trademarks
The trademarks, service marks, designs, and logos (collectively, the "Trademarks") displayed on the Site are the registered and unregistered Trademarks of Freedom Cups and its licensors.
You agree that you will not refer to or attribute any information to Freedom Cups or its licensors in any public medium (e.g., press release, websites) for advertising or promotion purposes, or for the purpose of informing or influencing any third party and that you will not use or reproduce any Trademark of, or imply any endorsement by or relationship with, Freedom Cups or its licensors.
3. Use of Site Content
Freedom Cups hereby grants you a non-exclusive, non-transferable license for the term hereof to access and download, display, and print one copy of the content and functionality displayed on the Site (the "Site Content") on any single computer solely for your internal, business use, provided that you do not modify the Site Content in any way and that you retain all copyright and other proprietary notices displayed on the Site Content. You may not otherwise reproduce, modify, distribute, transmit, post, or disclose the Site Content without Freedom Cups prior written consent.
4. User Postings
You acknowledge and agree that Freeedom Cups shall own and have the unrestricted right to use, publish, and otherwise exploit any and all information that you post or otherwise publish on the Site in postings, survey responses, and otherwise, and you hereby waive any claims against Freedom Cups for any alleged or actual infringements of any rights of privacy or publicity, moral rights, or rights of attribution in connection with Freedom Cups use and publication of such submissions.
You covenant that you shall not post or otherwise publish on the Site any materials that (a) are threatening, libelous, defamatory, or obscene; (b) would constitute, or that encourage conduct that would constitute, a criminal offense, give rise to civil liability, or otherwise violate law; (c) infringe the intellectual property, privacy, or other rights of any third parties; (d) contain a computer virus or other destructive element; (e) contain advertising; or (f) constitute or contain false or misleading statements. Freedom Cups does not and cannot review all information posted to the Site by users and is not responsible for such information. However, Freedom Cups reserves the right to refuse to post and the right to remove any information, in whole or in part, for any reason or for no reason.
5. Notices of infringement and takedown by Freedom Cups
Freedom Cups prohibits the posting of any information that infringes or violates the copyright rights and/or other intellectual property rights (including rights of privacy and publicity) of any person or entity. If you believe that your intellectual property right (or such a right that you are responsible for enforcing) is infringed by any content on the Site, please write to Freedom Cups at the address shown below, giving a written statement that contains: (a) identification of the copyrighted work and/or intellectual property right claimed to have been infringed; (b) identification of the allegedly infringing material on the Site that is requested to be removed; (c) your name, address, and daytime telephone number, and an e-mail address if available; (d) a statement that you have a good faith belief that the use of the copyrighted work and/or exercise of the intellectual property right is not authorized by the owner, its agent, or the law; (e) a statement that the information in the notification is accurate, and, under penalty of perjury, that the signatory is authorized to act on behalf of the owner of the right that is allegedly infringed; and (f) the signature of the intellectual property right owner or someone authorized on the owner's behalf to assert infringement of the right. Freedom Cups will remove any posted submission that infringes the copyright or other intellectual property right of any person under Singapore law upon receipt of such a statement. Singapore law provides significant penalties for submitting such a statement falsely. Under appropriate circumstances, persons who repeatedly submit infringing or unlawful material will be prohibited from posting further submissions.

6. Disclaimers
The content and functionality on the site is provided with the understanding that lf is not herein engaged in rendering professional advice and services to you. All content and functionality on the site is provided "as is," without warranty of any kind, either express or implied, including, without limitation, implied warranties of merchantability and fitness for a particular purpose. Freedom Cups and its third-party content providers make no warranties, express or implied, as to the ownership, accuracy, or adequacy of the site content. Freedom Cups shall have no liability or responsibility for any information published on linked websites, contained in any user submissions published on the site, or provided by third parties. Neither lf nor its third-party content providers shall be liable for any indirect, incidental, consequential, or punitive damages or for lost revenues or profits, whether or not advised of the possibility of such damages or losses and regardless of the theory of liability.
TERMS OF PURCHASE
Freedom Cups Terms and Conditions of purchased are as follow. If you have any questions, feel free to contact us , and we will do our best to help.
These Terms and Conditions (T&Cs) are a binding contract between Freedom Cups Pte. Ltd. and you as a purchaser (“Purchaser”) of Freedom Cups (the “Product(s)”).
1. Packaging
Freedom Cups come in a paper/cardboard box. Your address will be on the front, and ours at the back. Inside the parcel you will find your Freedom Cup, a cotton bag, and the instructions for use.
Samples of Goods are submitted as indicative of the quality of Goods to be supplied, without any guarantee or representation on the part of Freedom Cups as to the exact dimension, colour or physical characteristics.
For deliveries to countries outside Singapore, the customs declaration for the enclosed item will be ‘menstrual silicone cup’ .
2. Price
Inside Singapore or Malaysia: If you order a Freedom Cup online with delivery address inside Singapore, it will cost $33 SGD. Shipping is excluded.
Outside Singapore or Malaysia: If you order a Freedom Cup online with delivery address outside Singapore, one costs $33 SGD. We do not take responsibility for local duties and taxes that may be applied in the country of destination.
3. Security & Privacy
Your payments are handled through 1) Paypal that adhere to the global Payment Card Industry (PCI) Data Security Standard (DSS) developed by the international card networks Visa and Mastercard. 2) Stripe that is a level 1 PCI certified service provider, the most stringent level of certification available. Both Stripe and Paypal has the aim to deliver high quality payment systems with the best security and gives both customers ultimate data security as well as all other actors involved that are handling, transporting and storing your card information. At Freedom Cups, we do not store credit card details nor do we share customer details with any 3rd parties.
4. Delivery Times and Carrier
When your order payment has gone through, your order will be shipped within 2 working days. Orders within Singapore are made via J&T Express. You should receive your package within a period of maximum 8 working days but usually will receive it within a period of 5 to 7 days. Orders outside Singapore are sent through SingPost and can take anywhere between 14-21 working days but given the situation about Covid-19, may experience delays.
5. Shipment
Shipping and delivery costs are as follows:
Purchaser assumes title and bears risk of loss upon Freedom Cups delivery to carrier. Freedom Cups shall not be liable for late or incomplete delivery.
Freedom Cups may cancel this contract at any time before the Goods are despatched by giving written notice. On giving such notice Freedom Cups shall promptly repay the Purchaser any sums paid in respect to the price. Freedom Cups shall not be liable for any loss or damage whatever arising from such cancellation.
6. Inspection of Product
Purchaser shall promptly inspect the Product upon its arrival at the place of delivery and shall notify Freedom Cups, within 2 business days, if Purchaser finds any defect with the Product. After 2 business days, if there is no written notice of rejection, Purchaser shall be deemed to have fully and completely accepted the Product in its entirety.
Acceptance of delivery of the Products shall be deemed conclusive evidence of the Buyer's acceptance of these Conditions.
Freedom Cups cannot be held responsible for claims about or descriptions of the goods made by third parties on websites, electronic, printed or other media. If unsure please refer to our company website prior to purchase.
7. Return Policy
Given the situation around Covid-19, all sales are final. This is to protect our staff and customers. In situations where the mistake lay with Freedom Cups, credit will only be given to returns that are shipped, with delivery prepaid, and that arrive at Freedom Cups in re-saleable condition (except for returns of defective Product as determined by Freedom Cups). Only those Products that have never been used are eligible for return.
8. Limited Warranties and Disclaimer
Freedom Cups sells the Products on an “AS IS” basis, which may not be free of errors or defects, and, to the fullest extent permitted under applicable law, ALL EXPRESSED OR IMPLIED REPRESENTATIONS AND WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY, WORKMANLIKE EFFORT, CORRESPONDENCE TO DESCRIPTION, DESIGN, TITLE OR NON-INFRINGEMENT, OR ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR TRADE PRACTICE, ARE HEREBY DISCLAIMED.
9. Limitation of Liability; Exclusion of Consequential Damages
Notwithstanding any other provision of these Terms, to the fullest extent permitted under applicable law, Freedom Cups maximum aggregate liability for all claims, liabilities or obligations arising under or relating to these Terms or the Products, regardless of the theory of liability, will in no event exceed all amounts paid by Purchaser to Freedom Cups for the particular Product(s) giving rise to the claim, if any. In no event will Freedom Cups be liable for any indirect, punitive, special, incidental, exemplary, or consequential damages in connection with, related to or arising out of these Terms or the Products (including interruption of business, loss of profits, loss of revenue, loss of use, loss of consortium, or other economic or social advantage), regardless of the theory of liability, even if Freedom Cups has been previously advised of the possibility of such damages. Liability for damages shall be so limited and excluded, regardless of the validity or efficacy of any remedy and even if any remedy fails of its essential purpose.
10. Proper Use
Purchaser agrees to properly clean and maintain the Products (including submerging the Products in boiling water for at least 3 minutes once every month, prior to menstruation). Freedom Cups shall have no liability for any injuries or damages to persons or property resulting from incorrect or improper use or cleaning (or failure to perform regular cleaning) of the Products.
11. Force Majeure
Freedom Cups shall not be responsible for delays or failures in its performance resulting from acts or omissions beyond its reasonable control- like acts of God, war, civil disturbance, malicious damage, strike, lockout, industrial action, fire, flood, drought, extreme weather conditions, compliance with any law or governmental order, rule, regulation, direction or other circumstance beyond the reasonable control of either party- whatever the source or cause.
Each party shall give notice to the other upon becoming aware of a Force Majeure Event, the notice to specify details of the circumstances giving rise to the Force Majeure Event.
12. Governing Law
These Terms and all related disputes between the parties shall be governed by and construed in accordance with the laws of Singapore, without regard to any jurisdiction’s conflict of law provisions.
13. Arbitration
Any disputes between the parties or claims brought by one of the parties arising out of or related to these Terms or the Products (including tort as well as contract claims, and whether pre-contractual or extra-contractual, as well as the arbitrability of any disputes) shall be referred to and finally settled by binding arbitration before the International Court of Arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce (“ICC”) in effect at the time of arbitration except as inconsistent with this section.The arbitration shall be conducted by telephone, on-line and/or based solely upon written submissions where no in-person appearance is required. If in-person appearance is required, such hearings shall be held in Singapore. The arbitrator shall apply the law specified in the section above. All awards may if necessary be enforced by any court having jurisdiction. The existence of any dispute, the existence or details of the arbitration proceeding, and all related documents, materials, evidence, judgments and awards therein, shall be kept confidential. Except as required by law, no party shall make any public announcements with respect to the proceeding or the award, except as required to enforce same. The parties hereby waive the right to a trial by jury and agree to only bring claims in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. All claims between the parties must be resolved using arbitration in accordance with this section. Should either party file an action contrary to this section, the other party may recover lawyers’ fees and costs, provided that the party seeking the award has notified the other party in writing of the improperly filed claim, and the other party has failed to withdraw the claim.
14. Amendments
Any terms or conditions contained in any Purchase Order, acknowledgment, or other communication of Purchaser which are inconsistent with these Terms are hereby rejected. These Terms constitute the parties’ total and exclusive agreement. Any waiver, modification or amendment of any provision of these Terms will be effective only if in writing signed by duly authorized representatives of both parties.
